Terms of Service
This translation is provided for convenience only. The Hebrew text is the binding version.
These terms govern the use of the RE:MOMENTS site and the engagement between us and anyone who orders a film through it. Placing an order constitutes acceptance of the terms set out here, of the Cancellations & Refunds policy and of the Privacy Policy, subject to rights that cannot be contracted out of by law. The Hebrew original is written in the masculine form for convenience only and is addressed to all genders.
General — the site’s operators
The “RE:MOMENTS” site is operated by Eden Cohen, VAT-exempt dealer (Osek Patur) no. 313356040. “RE:MOMENTS” is a trade name; the engagement is with the trader named above.
To contact the site’s operators: WhatsApp 052-400-0820.
Ordering on the site is for adults (18 and over). A minor who would like a film orders it through a parent or guardian, who is the party to the engagement.
The digital invitations service — making an invitation, replies and the hosts’ management tools — is also governed by the terms on the “Invitations and guests — privacy and terms of use” page; where that page is silent, these terms apply.
The service and the packages
We produce short animated films from photographs the customer uploads. The film is produced specially for you — from your photographs and to your choices, in our production system and under our review — and is not a ready-made video. The service offered is The Memories Film, and these are the packages on offer:
- The Personal Film — a film of about 1:07 minutes at the usual pace, up to 8 photographs, ₪229. Includes: A personal opening · Music · A personal greeting · A personal ending · One round of corrections · up to 3 changes.
- Your Story — a film of about 1:58 minutes at the usual pace, up to 15 photographs, ₪339. Includes: A personal opening · Music · A personal greeting · Captions during the film · A personal ending · One round of corrections · up to 3 changes.
- The Extended Story — a film of about 2:48 minutes at the usual pace, up to 22 photographs, ₪459. Includes: A personal opening · Music · A personal greeting · Captions during the film · A personal ending · One video of yours, up to a minute · 2 rounds of corrections · up to 5 changes.
- The Event Film — a film of about 3:46 minutes at the usual pace, up to 30 photographs, ₪549. Includes: A personal opening · Music · A personal greeting · Captions during the film · A personal ending · One video of yours, up to a minute · 2 rounds of corrections · up to 7 changes.
The packages differ in the length of the film, the number of photographs, captions during the film and the number of rounds of corrections and changes included — as listed beside each package. A round of corrections is one consolidated request for changes. Every package includes:
- Smooth transitions between the photographs
- A personal opening and ending
- A song of your choice from our song list
- A personal greeting
- At least one round of corrections
There is no separate charge for the components above — they are part of the package price. These are the add-ons that can be added to an order for a separate charge:
- Delivery within 24 hours — ₪79.
- Videos of your own in the film — ₪15 a video, up to a minute each and up to 20 in a film. In a package that includes a video, as listed beside each package, the first video is part of the package price; every further video is charged at this price.
- Greeting videos with subtitles: ₪100 for up to 10 videos, ₪5 each more (up to 20 in a film).
- Extra photos in The Event Film — ₪10 a photo, up to 20 beyond those in the package.
- 4K restoration — ₪2 for every photo in the film (not for videos): every photo is restored and enlarged to 4K and also delivered as a file to download and print, beside the film. Without it, the usual restoration is included in every film.
The trader is a VAT-exempt dealer and charges no VAT, so the prices shown on the site are the final consumer prices, with no VAT added. A promotional price is shown beside the full price, and what you pay is the amount shown in the order summary before payment.
The preview on the site — the film that plays in the studio before you order — is an illustration of the photo order, pace, captions and song you chose. The finished film is produced according to those choices, so the details of the transitions, the exact timing, the cropping and the animation may differ from the preview. A song from the list that has no recording on the site yet is heard in the preview as a 30-second excerpt (courtesy of Apple Music); the whole song is added to the film in production. The order is for a film produced to your choices, not for an exact copy of the preview.
What you upload: photographs, a song, recordings and text
By uploading the photographs you declare and undertake that you own the rights in them or hold lawful permission to use them, and that you have the consent of every person appearing in the photographs to their use in producing the film — including their processing by artificial-intelligence systems and the creation of new motion, clips and figures of them (see below). It is your responsibility to obtain the consent of a parent or guardian where minors appear in the photographs. We do not ask for, and do not encourage, the upload of photographs of minors without such consent.
Recordings and video greetings. A dedication you recorded or uploaded, and video greetings that family and friends upload on the film’s greetings page, are included in the film only at your request. Whoever records or uploads such a clip declares that they appear in it, or have the consent of those who do; whoever ordered the film is responsible for sharing the greetings page only with the people they invite to send a greeting, and for choosing which greetings go into the film.
A song of your own. The site lets you upload a music file (MP3) to serve as the film’s music instead of a song from our song list. By uploading the song you declare and undertake that you hold every right needed in the work and in the recording to combine them with a private video film and to share the film — including the copyright in the composition and the performance, the performers’ rights and the right to synchronise the recording with video — or that the work was made by you or by a family member who has agreed. Buying a song, subscribing to a music service or downloading from the web does not, by itself, grant such rights. We do not check, and cannot check, the rights in a song; we rely on your declaration, which is recorded on the order, and we may refuse to include a song, remove it or replace it with a song from the list where infringement is a concern — without this being a breach of the order on our part.
The photographs, the song and the text remain yours. We receive a limited, non-exclusive licence in them, for the period required only: to store, copy, pass to our processing providers, process, edit and display them as far as needed to produce the film, deliver it, correct it, secure the service and meet a legal duty. We will not use them for any other purpose — not in advertising, not in a portfolio and not for training systems — except with your separate, explicit, written consent (see the Privacy Policy).
Processing by artificial intelligence. The motion, the completions and the transitions in the film are made in our production systems and by external processing providers, among them artificial-intelligence models that receive the photographs solely to generate the clips. The providers, where they are and the terms that apply to them are set out in the Privacy Policy. The output of such models varies from photograph to photograph, so we do not undertake that every movement will look identical, natural or perfect in every frame; such variance is handled within the rounds of corrections and is not a defect entitling you to cancel unless the film materially fails to match the order.
Prohibited content. Do not upload unlawful content; content that infringes copyright, trade marks, privacy, reputation or other rights of a person; prohibited sexual content or content connected with the exploitation of minors; content intended to harass, harm or incite; or material whose use breaches the law. We do not check, and cannot check, the origin of the material. If we suspect such content has been uploaded, we may pause production, ask for clarification or replacement material, delete the material or cancel the order under the Cancellations & Refunds policy, and report to the authorities where the law requires.
Responsibility and indemnity. If it turns out that any of the declarations above was not true — that the rights or consents in the photographs, the song or the text were not yours to give — the responsibility is yours alone. You undertake to indemnify us for any damage, expense, demand or claim by a third party (including demands by rights holders in the music, by collecting societies, by people appearing in the photographs, and reasonable legal costs) caused to us as a result, and to work with us in resolving any such demand. We will notify you of such a demand promptly and will not settle it in your name without asking you. Nothing in this clause detracts from rights that cannot be contracted out of by law.
Content made with artificial intelligence
Part of the film is made with artificial intelligence: the motion in the photographs and the transitions between them, and in some films whole new clips as well — a walk from one photograph to the next, an opening in which the figure steps into the first photograph, characters, layers and bridging clips. These clips are not a record of what happened: they are an artistic interpretation made from your photographs.
- Likeness to the people in the photographs is not guaranteed in every frame: facial features, age, build, clothing and background may change, and details that were not in the photographs — objects, movements, surroundings — may be created.
- Every film is checked and approved by us before delivery, and such faults are dealt with through change requests and the rounds of corrections. A departure from the original is not a defect entitling you to cancel unless the film materially fails to match the order.
- The generated clips may not be presented as a record of a real event in a way that could mislead, and the service may not be used to create content that shows a person without their consent, harms their dignity, privacy or reputation, or impersonates them. We may refuse to produce such content.
Rights in the finished film
Once payment is complete and the film is delivered, the finished film is yours. You may watch it, keep it, copy it, screen it and share it — with family, with friends, at the event and on social networks — for personal and family use, with no time limit and no limit on views, subject to the rights of third parties, to the terms of use of the song in it (below) and to the law. We ask for no credit.
The generic components used in producing it — templates, animations, transitions, fonts, our production systems and our and our providers’ editing tools — remain ours or their creators’, and your licence in them is for use within your film only. The film may not be sold, rented, taken apart into its components or used for commercial advertising or the promotion of a business without our written consent; we will gladly grant such a request, usually free of charge.
The song in the film. You choose the film’s song from our song list, or upload a song of your own (see above), and we include it in production. The song is included in the film for personal and family viewing and sharing only: the rights in the song itself — in the work and in the recording — are not sold to you, do not pass to you, and do not extend to commercial use, broadcast or public performance of the film. How you share the film is your responsibility, including on social networks and platforms that detect protected music automatically and may mute, block or remove the film; we are not responsible for such an action by a platform. A song you asked for in words that is not on the list is included only if we can include it lawfully; if not, we will offer you another song from the list. In a film with a song of your own, the rights in the song, and the responsibility for its use, are yours (see above). Screening the film at the event, with the song heard through speakers, is a public performance of the music: the licence for it — from ACUM and from the recording-rights bodies — is the venue’s or the hosts’ to hold, and is not part of buying the film.
The film’s page and the greetings page. You can share the film by a link to a page of its own, where anyone holding the link can watch the film and leave a blessing, and ask family and friends to upload video greetings on the greetings page. A blessing on the film’s page appears at once, and you can hide any blessing from your order page. We do not publish the links, but they are not protected by a password either: share them only with the people you want. Whoever writes a blessing or uploads a video is responsible for what they wrote or uploaded. The pages, the blessings and the video greetings are deleted together with the order’s files.
We will not show your film or use it for any purpose — including as an example on the site — except with your separate, explicit, written consent, which you may withdraw at any time.
Delivery times
The standard delivery time is 4 business days (Sunday to Thursday, excluding holidays). For an order purchased with the “Delivery within 24 hours” add-on, the delivery time is 24 hours. The clock starts from the moment the order is complete — payment approved and all the photographs received by us. When ordering through the studio the two happen together; when ordering through the order form, where the photographs are uploaded after payment, the clock starts when the photographs are uploaded. Change requests or photographs replaced during production may extend the date accordingly.
The film is delivered by a personal link sent to the e-mail address you provided. The film can be downloaded for 7 days from delivery: the site has no user accounts, so download it to your device within that period and keep a copy. When it ends the files are deleted and we cannot recover the film. The personal link itself is valid for 30 days, and shows the order’s details even after the film has been deleted.
If we missed the delivery date we committed to: on an order with the “Delivery within 24 hours” add-on, the surcharge for it is refunded to you in full, even if the film arrives only hours late. On any order, a delay in delivery not caused by you entitles you to cancel the transaction and receive a full refund within 14 days of the cancellation notice, with no cancellation fee, as provided in section 14E(a) of the Consumer Protection Law, 5741-1981 — and you may, of course, choose to wait for the film instead.
Force majeure: if an event beyond our control — a state of emergency, a disruption at a third-party service we rely on, illness — prevents us from meeting the date, we will let you know promptly and offer a new date. If the new date does not suit you, you may cancel and receive a full refund.
After delivery you can ask for corrections and changes on your personal order page, by marking the moments in the film that need them, and also ask to go back to an earlier version of the film you were given. How this works, and until when, is set out in the Cancellations & Refunds policy, under “The included round of corrections”.
Payment
Payment is made on the site, in full, when the order is placed, through an external payment processor (Grow). Credit card details are passed directly to the payment processor and are not stored by us. The order confirmation, and later the receipt, are sent to the e-mail address you provided. Further details are on the Privacy Policy page.
Bring a friend — discount codes
Every paid film order and every invitation published on the site has a discount code of its own. Whoever orders a film with such a code gets 10% off the order. The code is for the first order from an e-mail address that has not paid for an order before.
When an order placed with the code is paid, the code’s owner receives a personal credit code: 10% off another film order. The credit code is sent to the owner’s e-mail address (and, for an invitation, is also shown on the hosts’ share page); it can be used once, and is valid for one year from the day it was created.
Whoever ordered a film can also use their order’s code themselves, once: 10% off another film order of theirs. The code’s owner is recognised by the e-mail address or the phone number on the order, and such an order earns no credit code. The owner of an invitation’s code cannot use it themselves, and a further use of a code by its own owner gives no discount.
- The discount is calculated on the order’s total, rounded to a whole shekel, and is shown in the order form before payment. What you pay is the amount on the payment page.
- One code per order. Discount and credit codes cannot be exchanged for money, sold, or combined with one another.
- If an order placed with a code is cancelled, the refund follows the amount actually paid. A discount given against these rules, and a credit created by an order that was cancelled or by misuse of codes (for example orders placed only to collect credits), may be withdrawn.
Coupons
A coupon is a code we hand out, in a promotion or personally: a fixed amount off in shekels, or the whole service free of charge — as stated with the code. What a coupon gives is shown in the order form before you go on.
- One code per order: a coupon cannot be combined with a bring-a-friend code or with another coupon, and an order paid with a coupon earns no bring-a-friend credit.
- A fixed-amount coupon is taken off the order’s total, and never more than it; the rest is paid as usual, and an unused balance of the coupon is not kept. A coupon that covers the whole price opens the order with no payment, and it is produced like any other order.
- A coupon is valid until the end of the day set for it, on Israel’s clock, and for the number of orders set for it. A coupon that has expired, been used up or been stopped by us does not work.
- A coupon may be for a film only or an invitation only, for a given package or a bigger one, and for a given e-mail address — as stated with the code.
- A bundle of a film and an invitation is bought in two parts: each part is paid at its own price, and the bundle’s saving comes as a single-use code for the second part — for the bundle’s package or a bigger one, for the address it was sent to, for a year. A film paid for on the site as the first part earns its code for the invitation with the payment (a film a coupon covered in full earns none); when the invitation is bought first, we send the code for the film once it is paid for. If the first part is cancelled, the code it earned is cancelled too.
- A coupon has no cash value: it cannot be exchanged for money, sold or passed on for payment.
- If an order paid partly with a coupon is cancelled, the refund is the amount actually paid. An order a coupon covered in full is not entitled to a cash refund, and the coupon’s use does not return to it by itself.
- We may refuse a coupon that has been misused, or that was distributed without our permission.
Cancelling a transaction
The terms of cancellation, refunds and the round of corrections are set out on the Cancellations & Refunds page, and they form an integral part of these terms. The rights under the Consumer Protection Law, 5741-1981, and the regulations made under it apply in addition to the above, and nothing in these terms is intended to detract from them.
Reviews
After the film is delivered we send you one e-mail asking you to rate it and write a few words about it. The rating and the words are kept with us, and are shown on the site with the name you wrote only if you ticked explicitly that we may, and only after we have read them. We show them as written, without editing and without translating.
We may decline to publish a review, or remove it, among other reasons if it contains other people’s personal details, offensive or unlawful content, or content unrelated to the service. You may ask at any time for a published review to be removed or withdraw your consent, and it will be taken off the site.
Liability
We undertake to produce the film with skill and in good faith, according to the choices you made and by the date we committed to, and to correct it within the rounds of corrections included in the package. If the film delivered materially fails to match the order — for example photographs you supplied are missing, captions were swapped by mistake or a song other than the one chosen was used — you are entitled to a correction or a re-production, and if these do not resolve the mismatch, to a full refund, as set out in the Cancellations & Refunds policy.
We are not an archive. The photographs, the song and the film are kept with us for a limited period (see the Privacy Policy) and are deleted at its end. Keep your original material and the film you downloaded; we cannot recover files once they have been deleted.
We are not responsible for disruption, blocking or removal of the film on a third-party platform (a social network, a messaging service, a cloud), for a fault in your device or connection, or for the consequences of using the film contrary to these terms or to the terms of use of the song in it. The service is provided as it is, within the limits of the technology described above, and we do not undertake a particular artistic result beyond matching the order.
To the fullest extent permitted by law, our liability towards you in any matter connected with the order is limited to the amount you paid for it, and we will not be liable for indirect, consequential or punitive loss — except where the law does not allow liability to be limited, for example for damage caused wilfully or by gross negligence, or the rights granted to you by the Consumer Protection Law and the Privacy Protection Law, which cannot be contracted out of.
Intellectual property. The site, its design, its texts, the RE:MOMENTS trade mark, the templates, the site’s code and our production systems are protected by law. They may not be copied, reproduced, reverse-engineered or used for a commercial purpose without written permission. Nothing here detracts from your rights in the finished film as set out above.
We may change the site and the services, add options or discontinue them, from time to time. Such a change will not harm an order already paid for: it will be completed as ordered or, if there is no way to complete it, cancelled with a full refund.
Governing law and jurisdiction
These terms and the engagement are governed by Israeli law. Jurisdiction lies with the competent courts of Israel under the ordinary rules of jurisdiction, and nothing in this clause denies you the right to bring a small claim in the court nearest your home. Before any proceedings, we will gladly try to resolve any dispute directly.
Changes to these terms
We may update these terms from time to time. A material change will be published on this page at least 7 days before it takes effect, and customers with an open order will be notified by e-mail. Every order is governed by the version in force when it was placed, and the date of the last update appears below.
